   An act relating to local government finance.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 166, Baca.  Property tax revenue transfers:  County of San
Bernardino and City of Chino Hills.
   Existing law establishes various procedures for the negotiated
exchange of property tax revenues between jurisdictions in a county
in the event of a jurisdictional change.
   This bill would, subject to certain requirements and limitations,
authorize the County of San Bernardino and the City of Chino Hills to
enter into a written agreement for the annual transfer from that
county to that city of a specified percentage of certain additional
ad valorem property tax revenues, attributable to certain classes of
improvements to commercial or industrial properties that are
identified in the agreement.
   This bill would make legislative findings and declarations as to
the necessity for a special statute.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Notwithstanding any other provision of law, the County
of San Bernardino and the City of Chino Hills may enter into a
written agreement, for the annual transfer of ad valorem property tax
revenue from that county to that city, that does all of the
following:
   (a) Applies to the 2000-2001 fiscal year to the 2036-37 fiscal
year, inclusive, or any of those fiscal years.
   (b) (1) Specifies the amount of the transfer as 5.43 percent of
those additional property tax revenues that are derived from
improvements to commercial and industrial real properties, made on or
after January 1, 1999, that are specified in the agreement and are
either of the following:
   (A) A renovation or expansion of an existing structure or
structures that results in an increase in assessed value of at least
one million dollars ($1,000,000).
   (B) A new structure or structures.
   (2) Allows the percentage specified in paragraph (1) to be
renegotiated upon the written request of either the County of San
Bernardino or the City of Chino Hills.  Any percentage that is
determined pursuant to a renegotiation entered into under this
paragraph shall be deemed to be included in this section in lieu of
any conflicting percentage set forth in this section.
   (c) Directs the county auditor-controller to implement the revenue
transfer from the county to the city by commensurately adjusting the
amounts of apportionments of ad valorem property tax revenue,
previously determined as otherwise provided by law by the County
Auditor-Controller for the County of San Bernardino and the City of
Chino Hills.  The revenue transfer from the county to the city shall
be made after all required allocations have been made.
   (d) Provides that it may be terminated under specified
circumstances, that shall include, but are not limited to, the
following:
   (1) Any land located in the city is included within a
redevelopment project area.
   (2) Written notice of termination being given by either the County
of San Bernardino or the City of Chino Hills in the 2001-02 fiscal
year, or any fiscal year thereafter, if any modification by the
Legislature of the requirements for the allocation or apportionment
of ad valorem property tax revenues necessarily requires a change,
from the immediately preceding fiscal year, in the ratio of the total
amount of ad valorem property tax revenue received by that county to
the total amount of ad valorem property tax revenue received by that
city.
  SEC. 2.  The Legislature finds and declares that a special law is
necessary and that a general law cannot be made applicable within the
meaning of Section 16 of Article IV of the California Constitution
because of the unique funding, public service, and jurisdictional
concerns involving the County of San Bernardino and the City of Chino
Hills.
